Pro bono appeal

Summary:  On a pro bono basis, we undertook a direct appeal to the California Supreme Court brought by an indigent criminal defendant who had been convicted of capital murder and sentenced to death.  We also handled the related petition for writ of habeas corpus.

Result:  A published decision on the direct appeal which resulted in a reversal of certain of the counts on which the client had been convicted and a published decision following the habeas corpus proceeding in which the court unanimously overturned the death sentence.

Attorneys’ fee appeal

Summary:  We represented a convenience store owner on appeal who brought suit, claiming that he had been defrauded in the purchase of the business.  The client lost at trial before a jury and following post-trial motions, the trial court ordered the client to pay a large attorneys’ fee award to the prevailing party.  We were retained after trial to handle the appeal.

Result:  We successfully obtained a reversal of the attorneys’ fee award.

Casino challenge appeal

Summary: We represent a group of citizens who are challenging the continued operation of an Indian casino which is located in the midst of an urban area.  The action was brought in the U.S. District Court for the District of Columbia.  The case raises complex issues of federal administrative, constitutional and Indian law.  It is currently on appeal to the U.S. Circuit Court of Appeals for the District of Columbia Circuit.

Result: Appeal pending in the Court of Appeals.
